Magazine Editor arrested for online defamatory article

Tvm: T P Nandakumar, Chief Editor of a popular Malayalam investigative and crime news fortnightly called Crime, was arrested on Saturday by the Cyber Police for publishing an offensive and defamatory article about a NRI businessman on its website. He was arrested on the basis of a complaint by an Abu Dhabi based businessman, Alexander.

Alexander who is from Kottayam District had earlier filed a defamation case against Nandakumar about an article in the magazine which was defamatory in nature. In its order, the Ernakulam District Sessions Court had asked Nandakumar not publish anything on this issue unless the petition was disposed off but this article later appeared on the magazine’s online edition.

After this, Alexander filed another complaint with the police and based on a directive by the DGP, the Cyber Crime Police Station took up the case under the IT Act as the article appeared online. The Cyber Police raided the office of the magazine in Kochi and the Editor was arrested under Section 66 A of the IT Act, 2008.

The police also arrested Raju Hariharan, the Sub-Editor of the magazine for uploading the article on the website. He was arrested from his house in Pala, from where the article was uploaded. Both of them were later granted bail.
